Before using Section 113P
Before using Section 113P to copy text or images without permission, you should do the following:
- Check the copyright status of the text or images – you may not need to use Section 113P
- Seek permission from the copyright owner – again you may not need to use Section 113P
- Check for explicit terms on the material or on the website that the material is communicated from – you may not be able to use Section 113P. (See Existing licence terms and /wiki/spaces/COP/pages/32276539 for more)
If you find that the text or images you want to use are:
- protected by copyright, and
- you don’t have permission to use them, and
- not protected by terms that prevent you from using Section 113P
Then you can use a specified portion of that material under Section 113P of the Copyright Act for educational purposes. See Statutory Text and Artistic Licence for more information.
Online Copyright Statements
If a web site contains no permitted use statement or only contains a basic copyright statement then Section 113P applies.
