If a brand is visible in a video, it will fall into one of the following categories:

  1. Incidental: This is where the appearance of the brand is incidental, for example a branded food item that appears for a few seconds or a branded object appearing in the background for a small part of the video. In this case permission is not required, although it would be preferable to avoid these where possible.
  2. A key focus of the video: If the branded product is the main ficus of the video, for example a video of construction equipment demonstrating tasks, or of a beauty treatment using specific products, then we need to obtain written consent from the owner of the trademark to show that brand in the video.
